For safety reasons Kinect probably don't use a 60mW IR laser. This would be a class 3 laser product which can be very dangerous. Moreover there is not warning laser label on Kinect, which is mandatory even for class 1 products. I suppose they use an high power IR LED that illuminates a matrix of microlens representing the structured dot pattern with secondary lens that projects the image of the focused dot matrix.
